ફટાકડા પર સમૂળગો પ્રતિબંધ મૂકવાની માગ સુપ્રીમ કોર્ટે ફગાવી, ગ્રીન ક્રેકર્સને લીલી ઝંડી

દિવાળીના તહેવારોના ઉપલક્ષમાં આજે સુપ્રીમ કોર્ટે ગ્રીન ક્રેકર્સ એટલે કે લૉ કાર્બન અને ઓછું પ્રદૂષણ ફેલાવતા ફટાકડાનું ઉત્પાદન, વેચાણ અને ફોડવાની બાબત પર કોઇપણ પ્રકારની રોક લગાડવાનો ઇન્કાર કરી દીધો છે.

સુપ્રીમ કોર્ટ ઓફ ઇન્ડિયાએ આજે ભારતમાં દિવાળીના તહેવારો કે અન્ય પ્રસંગોએ ફટાકડાનું ઉત્પાદન કરવા, વેચાણ કરવા કે ફોડવા પર પ્રતિબંધ (બ્લેંકેટ બેન) મૂકવાની દરખાસ્ત ફગાવી દીધી છે. સુપ્રીમ કોર્ટે કહ્યું કે ધોરણસરના ફટાકડાનું ઉત્પાદન કરી શકાશે, નિર્ધારિત સમયે તેને ફોડી પણ શકાશે. ફટાકડાનું વેચાણ ચોક્કસ માર્કેટમાંથી જ કરી શકાશે, લારીઓ કે ફૂટપાથ પર બિલકુલ પણ ફટાકડા વેચી શકાશે નહીં. સુપ્રીમ કોર્ટે એ પણ નિશ્ચિત કર્યું છે કે જો કોઇ પોલીસ મથક વિસ્તારમાં નિર્ધારિત ધારાધોરણોનો ભંગ કરતા ફટાકડાનું વેચાણ થતું ઝડપાશે, અગર તો નિર્ધારિત સમય ઉપરાંત ફટાકડા ફૂટતાં જોવા મળશે તો જે તે પોલીસ મથકની જવાબદારી નિશ્ચિત કરીને શિક્ષાત્મક પગલાં ભરવામાં આવશે.

• ફટાકડા અંગે આજરોજ તા.23મી ઓક્ટોબર 2018ના રોજ સુપ્રીમ કોર્ટ દ્વારા આપવામાં આવેલા મહત્વના આદેશો આ મુજબ છે.
• દિવાળીના તહેવારોમાં રાત્રે 8 વાગ્યાથી 10 વાગ્યા દરમિયાન ફટકડા ફોડી શકાશે.
• નવા વર્ષ ક્રિસમસ સેલિબ્રેશનના દિવસોમાં રાત્રે 11.45 કલાકથી 00.30 કલાક સુધી ફટાકડા ફોડી શકાશે.
• ઓનલાઇન શોપિંગ સાઇટ્સ કે જેઓ આડેધડ રીતે ફટાકડાઓનું વેચાણ કરી રહી છે તેમણે પદ્ધતિસર કેવી રીતે ફટાકડા વેચી શકાશે, નીતિ નિયમોની જાળવણી કેવી રીતે થશે એ અંગે સુપ્રીમ કોર્ટને જણાવવું પડશે એ પછી તેમને મંજૂરી મળશે એ સંદર્ભનો આદેશ પણ અપાયો છે.
• લારીઓ કે ફૂટપાથ પર કોઇપણ સંજોગોમાં ફટાકડાનું વેચાણ કરવાની મંજૂરી આપી શકાય નહીં.
• નિર્ધારિત ડેસીબલની મર્યાદામાં અવાજ કરતા હોય તેવા ફટાકડા વેચવાની જ ફટાકડા બજારમાં મંજૂરી આપી શકાશે.

Ahead of Diwali, the SC permitted the sale and manufacture of “green” crackers which have low emission across the country.

• The apex court fixed 8 pm to 10 pm time period for bursting of firecrackers on Diwali.
• For New Year and Christmas celebrations, bursting of firecrackers will be allowed between 11:45 pm to 12:30 am.
• However, it restrained e-commerce websites like Flipkart and Amazon from selling firecrackers.
• It said e-commerce websites will be hauled up for contempt of court if they don’t adhere to the direction.
• The SC also said that selling of ‘larries’ or series firecrackers will not be allowed in the country.
• Only the firecrackers with permissible decibel sound limits will be allowed to be sold in the market.
• The top court asked the Centre to encourage community cracker bursting during Diwali and other festivals in Delhi-NCR.
• It also directed all the states to explore the feasibility of community cracker bursting during festivals.
• Station house officers of police station concerned will be held liable if banned firecrackers are sold in their areas.
